Find a way, or make one.

Business, civil and employment law in São José dos Campos, Brazil, since 2007. For companies, and for the people behind them.

About the firm

One partner, from start to finish.

Clients deal with a partner, from the first contact to the final decision. No intermediaries.

The legal department the company does not have.

The firm takes on the company's legal management: it decides alongside the client, brings in specialists when needed and answers to the client for all of the work.

Relationships that last.

The firm's first clients, from 2007, are still clients.

The Firm

Since 2007

Khouri, Pereira Sociedade de Advogados began in 2007 with one rule: every client is served personally by a partner, and every matter is the direct responsibility of a partner. The rule still stands.

The firm does not hand its clients off. Associate lawyers handle cases, hearings and filings under the partners' direction; the client relationship, and the responsibility for it, stays with the partners.

Hence what the firm values most: clients who stay. The first, from 2007, are still clients. There is no measure the firm is prouder of.

Aut viam inveniam aut faciam.

Find a way, or make one. The firm exists for matters with no ready answer: the contract no one wants to sign, the partnership that refuses to dissolve, the accident the employer denies, the treatment the health plan refuses. The method is to study the case until the way is found. And, where there is none, to build it.

The firm practices what it handles every day: employment, civil, real estate, business, corporate, succession and health law. When a matter calls for another specialty, it selects the specialist, takes part in the engagement and sees the work through at the client's side. For companies, it is the legal department they do not have. For their owners, the adviser who knows both the business and the family.

To the firm, the company's problem and the owner's problem are one and the same. When a case requires it, the firm follows the client anywhere in Brazil, and beyond.

Partners

Two founding partners, each personally accountable to the clients of his practice.

Charles Edouard Khouri

Charles Edouard Khouri

Founding partner, head of the civil and business practice and of national and international legal management

OAB/SP 246.653

A lawyer since 2006. He practices civil litigation, real estate, business and corporate law, and succession throughout Brazil, and directs the legal management of Brazilian and foreign companies that have no in-house legal department in Brazil.

Law degree from Mackenzie Presbyterian University. Postgraduate degrees in Business Administration and in Business Law from Fundação Getulio Vargas (FGV).

He knows companies from the inside. He served on the Municipal Economic Development Council of Jacareí and as a director of the Mogi das Cruzes Commercial Association, a century-old institution affiliated with FACESP, and sits on the boards of companies in the Paraíba Valley and Alto Tietê regions. He practices law from the business outward, not merely from the case file.

From 2019 to 2023, he sat as reporting member of the 16th Panel of the Ethics and Disciplinary Tribunal of the São Paulo Bar (OAB/SP), judging the conduct of other lawyers. He knows, from the bench, what the profession demands of those who practice it.

Matheus Pereira Luiz

Matheus Pereira Luiz

Founding partner, head of the employment practice

OAB/SP 243.040

A lawyer since 2005. He practices employment law for companies, employees and executives. Workplace accidents and occupational disease are at the core of his practice.

Law degree from Mackenzie Presbyterian University. Postgraduate degrees in Employment Law from FGV Law and in Business Management from Fundação Dom Cabral. MBA in People Management from Fundação Getulio Vargas.

He reads an employment dispute from both sides of the table. His training in people management and his experience in human resources give him the employer's view; representing employees gives him the view of those who bear the consequences. He has served on the advisory boards of technology companies in the São José dos Campos and Mogi das Cruzes regions.

Each practice is led by a partner, who answers for it to the client.

Employment Law

Partner in charge: Matheus Pereira Luiz

The firm works on both sides of the employment relationship: it defends companies and represents employees and executives. Those who know the other side's argument can anticipate it, and that anticipation is what the client receives.

For companies

Prevention before litigation: hiring, compensation, working hours, terminations and review of the practices that create liabilities. Defense in labor claims at every level, and in labor inspections and administrative proceedings. For companies served on an ongoing basis, the firm takes part in personnel decisions before they become lawsuits.

For employees and executives

Terminations and unpaid entitlements. Overtime and working hours. Positions of trust. Equal pay. Workplace harassment. Unrecognized employment relationships. For executives: negotiated exits, variable pay, bonuses, non-compete covenants and the other clauses that survive the contract.

Workplace Accidents and Occupational Disease

Partner in charge: Matheus Pereira Luiz

A workplace accident changes a life in seconds. Its legal consequences last for years, and they begin to be decided in the first days.

It is the matter to which the firm devotes the most attention within its employment practice. It acts for employees and for employers, on the two fronts every case opens: social security, before the INSS, Brazil's National Social Security Institute; and litigation, before the Labor Courts.

What counts as a workplace accident

Not only a sudden event at the workplace. Also any disease caused or aggravated by the work, such as repetitive strain injuries, spinal conditions and work-related psychological disorders, and accidents on the way between home and work.

What is at stake

The Workplace Accident Report (CAT) is the first step, and where the first mistake is made. It determines the accident benefit, twelve months of job security after the INSS leave ends, and the employer's FGTS deposits during the leave. Where the employer is at fault, or the activity is inherently risky, the worker may claim compensation for material, moral and aesthetic damage, and a pension for lost working capacity.

How the firm works

For employees: medical and documentary evidence organized from day one, follow-up of the expert medical examination, and handling of the claim, administrative and judicial. For employers: analysis of the causal link between the work and the injury, guidance on issuing the CAT and managing the leave, and a firm defense when liability is attributed without grounds.

Civil and Business Law

Partner in charge: Charles Edouard Khouri

Contracts, property, partnerships, inheritance: in a business owner's life, these matters intertwine. The firm handles them together, through a single counterpart.

Civil litigation

Claims and defenses in the state courts, at every level, and before Brazil's higher courts. Enforcement of judgments and debt collection, for creditors and debtors alike: asset tracing, attachment, account freezes. Piercing the corporate veil, to reach those who hide behind a company, or to protect those reached without grounds.

Real estate

Purchase and sale, exchange and leasing, residential and commercial. Development and land subdivision. Regularization of property and title. Possession, ownership, contract terminations and fiduciary liens. The firm examines the deal before signing, while litigation can still be avoided, and takes it on when it no longer can.

Contracts and companies

Drafting, review and negotiation of commercial contracts. Company formation, shareholders' agreements and amendments to the articles of association. Admission and exit of partners, valuation of partnership interests and dissolution. Disputes between partners, where the company itself is at stake, not merely the lawsuit.

Succession and estate planning

The succession of a family business is decided before probate. The firm organizes the transfer of assets and management during the owners' lifetime, using holding companies, gifts, wills and shareholders' agreements tailored to each family. Once succession has opened, it handles probate and estate partition, in or out of court.

Health law

High-cost treatments and medications cannot wait. The firm challenges health plan denials and seeks from the public health system the supply of medications and treatments: cancer drugs and immunotherapy, biologics, medications for rare diseases, therapies for autism spectrum disorder, home care, surgery and special medical devices.

A denial based on the coverage list of the ANS, Brazil's health plan regulator, on off-label use or on the allegedly experimental nature of a treatment does not end the matter. The firm gathers the medical evidence for the emergency injunction from the outset and follows the enforcement of the decision, with fines and the freezing of funds when necessary, until the treatment reaches the patient.

Consumer law

Defense of companies in consumer complaints, before consumer protection agencies (PROCON) and in court. Representation of consumers when the harm goes beyond the value of the product.
